§1
Regulamin został sporządzony na podstaiwe Ustawy o Ochronie Zwierząt z dnia 21 sierpnia 1997 r. Dz.U. z 2003 nr 106 poz. 1002 z późniejszymi zmianami oraz Rozporządzeniem Rady (WE) nr 1/2005 z dnia 22 grudnia 2004 r. w sprawie ochrony zwierząt podczas transportu i związanych z tym działań oraz zmieniające dyrektywy 64/432/EWG i 93/119/WE, rozporządzenie (WE) nr 1255/97, rozporządzenie PE i Rady (UE) 576/2013 i 577/2013
§2 Przewóz psów, kotów, fretek pod opieką - wymagania weterynaryjne
1. Do przewozu przeznaczone mogą być tylko zwierzęta zdrowe zdolne do transportu, wyjątek stanowią zwierzęta przewożone do gabinetów i klinik weterynaryjnych na pisemne polecenie lekarza weterynarii.
2. Minimalny wiek zwierząt przewożonych pod opieką to 8 tygodni w przewozie krajowym i 15 tygodni w przewozie międzynarodowym, chyba że Państwo docelowe zezwala inaczej: tj. np w sytuacji podrózy szczeniąt wraz z matką, która spełnia wszelkie wymogi weterynaryjne zezwalające na przemieszczanie.
3. Punkt 2 nie ma zastosowania w przewozie krajowym, jeżeli przewożonemu młodemu zwierzęciu (poniżej 8 tygodni) towarzyszy matka, oraz jeśli zwierzę nie miało kontaktu z fauną spoza miejsca pobytu, a miejsce pobytu
4. Przewożone zwierzę powinno być wyraźnie oznakowane poprzez chip jedyną możliwą i uznawaną w transporcie międzynarodowym formą znakowania zwierząt domowych
5. Przewożone zwierzę powinno być zaszczepione przeciwko wściekliźnie jeżeli ukończyło 12 tydzień życia, chyba,że przepisy umożliwiają transport poniżej tego wieku.
6. Przewożone zwierzę powinno być odrobaczone (Echinococcus) i odkleszczone najpóźniej 24 godziny i nie dalej niż 72 godziny przed planowanym wyjazdem (odkleszczenie dotyczy miesięcy od lutego do października).
⚠️⚠️⚠️7. Przewożone zwierzę powinno posiadać
a) książeczkę zdrowia przy przewozie krajowym, b) paszport dla zwierzęcia domowego przy przewozie międzynarodowym, traces (Intra EU) oraz badanie kliniczne, a także pisemne upoważnienie do tego rodzaju przewozu.
8. Jeżeli wynika to z przepisów zewnętrznych, zwierzę w wewnątrzwspólnotowym transporcie komercyjnym lub przy wyjeździe/przyjeździe do/z kraju trzeciego (poza UE), powinno posiadać także odpowiednie świadectwo zdrowia wydane przez Uprawnionego Lekarza Weterynarii. 9. Osobą odpowiedzialną za właściwe przygotowanie dokumentacji weterynaryjnej jest Zleceniodawca. Wykonawca nie ponosi odpowiedzialności za błędy i braki w przygotowanej dokumentacji.
§3 Warunki przewozu
1. Przewóz zwierząt odbywa się w certyfikowanych transporterach dostosowanych do wielkości przewożonego zwierzęcia, tak aby zapewniało komfort podrózy i nie stresowało dodatgowo zwierzęcia.
2. Trasa przejazdu jest dobierana optymalnie, by podróż odbywała się możliwie jak najkrótszą drogą.
3. O dacie i godzinie odbioru oraz dotarcia zwierzęcia w miejsce docelowe Nadawca i Odbiorca zostaną poinformowani ustnie, telefonicznie bądź drogą elektroniczną przez Wykonawcę.
4. Godzina dotarcia zwierzęcia w miejsce docelowe nie jest gwarantowana przez Wykonawcę, chyba że w pisemnym zleceniu uzgodniono inaczej.
5. W przypadku wystąpienia siły wyższej, która uniemożliwi wykonanie przez Wykonawcę usługi, umowa pozostaje w mocy, jednak obowiązki wynikające ze zlecenia zostają odłożone w czasie do momentu ustania działania siły wyższej.
6. Wykonawca nie ubezpiecza indywidualnie zwierząt na czas transportu, chyba że strony postanowią inaczej.
7. Kierowca lub Opiekun ma prawo odmówić przyjęcia zwierzęcia jeżeli nie zostały zachowane wymagania zapisane w powyższym regulaminie., tj.: zwierzę jest brudne, chore lub wygladające na chore, niedożywione, odpoiednio nie zaszczepione, odrobaczone, nie posiadające zapasu pokarmu na czas transportu, nie ma możliwości odczytu numeru czip i/lub kierowca/ konwojent nie był w stanie odczytać nr czip, a także kiedy zlecony przez jedną ze stron test na wirusy, bakterie lub inne patogeny dał wynik pozytywny ( w tym przypadku nadawca lub strona umowy winien jest zwrócić umówioną kwote za usługę w kwocie 100% ceny usługi).
§4 Obowiązki Zleceniodawcy
1. Zleceniodawca zobowiązany jest do przygotowania całej dokumentacji weterynaryjnej zgodnie z § 2. do dnia wyjazdu zwierzęcia, a jeśli nie jest w stanie tego dokonać, może wyznaczyć notarialnie reprezentanta lub zleceniobiorca może pomóc w załatwianiu formalności odpłatnie.
2. Zwierzę do przewozu powinno być czyste i przygotowane w należyty sposób a zleceniobiorca winien być poinformowany zgodnie z prawdą o nawykach, stanie psychicznym oraz predyspozycjach zwierzęcia i czy nie wykazuje agresywnych zachowań w stosunku do obcych mu ludzi.
3. Zleceniodawca zobowiązuje się do obecności w miejscu przeznaczenia w godzinach wskazanych przez Wykonawcę lub wyznaczenie innej osoby, o której niezwłocznie powiadomi Wykonawcę telefonicznie lub drogą elektroniczną zgodnie z § 3 punkt 3. O zmianach terminu Zleceniodawca zostanie niezwłocznie poinformowany telefonicznie bądź drogą elektroniczną.
§5 Płatności
1. Przy ustalaniu należnego dla Wykonawcy wynagrodzenia, przyjmuje się stawki według ogólnie stosowanego przez niego cennika, albo określone w szczególnej ofercie. 2. Opłaty za wykonaną usługę zostaną dokonane przez Zleceniodawcę najpóźniej do momentu wyjazdu zwierzęcia gotówką lub przelewem (jako datę zapłaty uznaje się datę wpływu na konto Wykonawcy) na wskazane w umowie świadczenia usług konto bankowe. Jeżeli strony ustalą inaczej, płatność może zostać dokonana przy odbiorze zwierzęcia z transportu gotówką. Wykonawca może uzależnić przystąpienie do wykonywania zlecenia od uiszczenia przedpłaty. 3. Wynagrodzenie Wykonawcy może ulec podwyższeniu jeżeli:
- w sposób niezależny od Wykonawca i niemożliwy dla niego do przewidzenia nastąpiły znaczące zmiany w opodatkowaniu lub innych obciążeniach publicznych, bądź w kosztach przewozu, frachtu i podobne lub odbiorca nie jest płatnikiem podatku VAT lub w inny sposób nie rozlicza się z Urzędem Skarbowym w miejscu docelowym ( zamieszkania, hodowli etc)
- w trakcie wykonywania umowy na życzenie Nadawcy/Odbiorcy, dokonywano dodatkowych czynności lub zlecenie zostało rozszerzone o nowe przedmioty, bądź wykonanie dodatkowych czynności okazało się konieczne w celu wykonania zlecenia;
- koszt uzupełnienia niezbędnej dokumentacji weterynaryjnej wynosi jednorazowo 50 PLN plus wszelkie koszty poniesione przez Wykonawcę w związku z wykonaniem tej czynności.
- Zleceniodawca przed ustaleniem wynagrodzenia nie podał wszystkich istotnych okoliczności towarzyszących wykonywanego zlecenia;
- czas wykonania zlecenia uległ znacznemu wydłużeniu z przyczyn nie leżących po stronie Wykonawcy – siła wyższa
- odbiorca lub nadawca zarzyczą sobie dodatkowej usługi weterynaryjnej w postaci szybkiego testu na choroby wirusowe, bakteryjne lub inne patogeny np. Lambia. Koszt takiego testu to 50 euro lub 210 zł.
4. Zleceniodawca jest zawsze zobowiązany do zwrotu kosztów poniesionych przez Wykonawcę nałożonych przez jakiekolwiek władze. Wyżej wymienione koszty podlegają zwrotowi również w wypadku korzystania przez Wykonawcę z podwykonawców.
5. Zleceniodawca jest zawsze zobowiązany do zwrotu kosztów poniesionych przez Wykonawcę w przypadku zaistnienia sytuacji opisanej w §3 punkt 7 w wysokości 2,50 PLN za każdy kilometr jaki dzieli siedzibę Wykonawcy a siedzibę Zleceniodawcy - miejsce nadania / odbioru zwierzęcia, lub 100% kosztów przewozu w sytuacji kiedy szybki test na wirusy, bakterie lub inne patogeny da wynik pozytywny.
6. Wykonawca uzależnia wydanie zwierzęcia z transportu od uregulowania płatności według
§5 punktu 2. 7. W przypadku sytuacji omówionej w §5 punkt 6 Wykonawca ma prawo umieścić zwierzę w hotelu dla zwierząt do czasu uregulowania płatności. Koszt pobytu w hotelu doliczany jest do wynagrodzenia dla Wykonawcy.
§6 Odwołanie rezerwacji
1. Zleceniodawca może wypowiedzieć umowę (odwołać rezerwację):
- Bezpłatnie do 14 dni przed planowanym wyjazdem.
- W terminie 14 – 7 dni przed planowanym wyjazdem Zleceniodawca zobowiązuję się do zapłaty 40 % wartości umowy do dnia wskazanego w umowie.
- W terminie 6 – 0 dni przed planowanym wyjazdem Zleceniodawca zobowiązuje się do zapłaty 100% wartości umowy do dnia wskazanego w umowie.
2. Zleceniodawca może przenieść rezerwację jednorazowo w każdej chwili na wskazany przez siebie termin nie dalszy niż 1 rok. Opłata za zmianę terminu wynosi 150 PLN.
3. Przy zmianie terminu przewozu Zleceniodawca ma prawo zmienić przewożone zwierzę oraz miejsce nadania lub odbioru zwierzęcia. Wykonawca przeliczy zmianę według obowiązującego cennika (nie mniej niż wartość pierwotnej umowy) o czym niezwłocznie poinformuje Zleceniodawcę w celu zatwierdzenia.
4. Opłaty za rezerwację, która zostaje zmieniona, Zleceniodawca uiści do dnia pierwotnego wyjazdu. Pozostałe opłaty nie później niż do dnia rzeczywistego wyjazdu.
5. W przypadku, gdy liczba zwierząt zgłoszonych do przewozu na danej trasie będzie niższa niż 5 (pięć), Wykonawca zastrzega sobie prawo do odwołania zaplanowanego kursu z przyczyn organizacyjnych. W takim przypadku Zleceniodawca ma prawo do wyboru jednej z następujących opcji:
a) zwrotu wpłaconej zaliczki w terminie do 30 dni od dnia odwołania kursu, lub
b) bezpłatnej zmiany rezerwacji na inny dostępny termin realizacji usługi, bez naliczania opłaty za zmianę terminu.
Jeśli chcesz, aby zapis jeszcze lepiej zabezpieczał firmę, można go doprecyzować:
Wykonawca poinformuje Zleceniodawcę o odwołaniu kursu niezwłocznie po stwierdzeniu, że minimalna liczba 5 zwierząt na danej trasie nie została osiągnięta. Odwołanie kursu z tej przyczyny nie stanowi niewykonania umowy z winy Wykonawcy i nie rodzi po stronie Zleceniodawcy prawa do dochodzenia odszkodowania ani innych roszczeń poza zwrotem wpłaconej zaliczki lub bezpłatną zmianą terminu rezerwacji.
§7 Postanowienia końcowe
1. Niniejszy Regulamin Przewozu Zwierząt stanowi ogół zasad, jakie obowiązują miedzy Zleceniodawcą a Wykonawcą, jeżeli w konkretnej umowie indywidualnej strony nie postanowiły inaczej. 2. W sprawach nieuregulowanych w umowie indywidualnej lub Regulaminie Przewozu Zwierząt mają zastosowanie odpowiednie przepisy Kodeksu Cywilnego, publicznego i prywatnego prawa międzynarodowego oraz przyjęte zwyczaje. 3. Wszelkie odstępstwa od zasad określonych w indywidualnej umowie lub Regulaminie Przewozu Zwierząt wymagają formy pisemnej pod rygorem nieważności. W sprawach sporu sądowego, właściwym dla rozstrzygania spraw związanych z usłągą transportu, ma Sąd właściwy dla siedziby firmy Omnibus.Pets transport zwierząt, Bartosz Gałka.

§1
The Regulations have been drawn up on the basis of the Animal Protection Act of August 21, 1997. Dz.U. of 2003 No. 106 item 1002 as amended and Council Regulation (EC) No 1/2005 of 22 December 2004 on the protection of animals during transport and related operations and amending Directives 64/432/EEC and 93/119/EC, Regulation (EC ) No 1255/97, Regulations of the European Parliament and of the Council (EU) 576/2013 and 577/2013
§2 Carriage of dogs, cats, ferrets under care - veterinary requirements
1. Only healthy animals capable of transport may be intended for transport, with the exception of animals transported to veterinary surgeries and clinics at the written request of a veterinarian.
2. The minimum age of animals transported under care is 8 weeks in domestic transport and 15 weeks in international transport, unless the State of destination allows otherwise: i.e. in the case of puppies traveling with their mother who meets all veterinary requirements permitting movement.
3. Point 2 does not apply to domestic transport, if the transported young animal (under 8 weeks old) is accompanied by its mother, and if the animal has not had contact with fauna from outside the place of stay, and the place of stay
4. The transported animal should be clearly marked with a chip, the only possible and recognized form of marking pets in international transport
5. The transported animal should be vaccinated against rabies if it is over 12 weeks of age, unless regulations allow for transport below this age.
6. The transported animal should be dewormed (Echinococcus) and ticked at least 24 hours and no later than 72 hours before the planned departure (de-tick applies to the months from February to October).
7. The transported animal should have
a) a health book for domestic transport, b) a pet passport for non-commercial international transport and a written authorization for this type of transport.
8. If it results from external regulations, an animal in intra-Community commercial transport or when leaving/arriving to/from a third country (outside the EU) should also have an appropriate health certificate issued by an Authorized Veterinary Doctor. 9. The person responsible for the proper preparation of veterinary documentation is the Principal. The Contractor is not responsible for errors and omissions in the prepared documentation.
§3 Conditions of carriage
1. The transport of animals takes place in certified transporters adapted to the size of the transported animal, so as to ensure the comfort of the journey and not to additionally stress the animal.
2. The route is selected optimally so that the journey takes place as short as possible.
3. The Sender and the Recipient will be informed verbally, by phone or by e-mail by the Contractor about the date and time of collection and arrival of the animal at its destination.
4. The time of arrival of the animal at the destination is not guaranteed by the Contractor, unless agreed otherwise in a written order.
5. In the event of force majeure that prevents the Contractor from performing the service, the contract remains in force, but the obligations arising from the order are postponed until the force majeure ceases.
6. The Contractor does not individually insure animals for the duration of transport, unless the parties agree otherwise.
7. The driver or guardian has the right to refuse to accept an animal if the requirements set out in the above regulations have not been met, i.e.: the animal is dirty, sick or looks sick, malnourished, not properly vaccinated, dewormed, not having a supply of food for transport, there is no possibility to read the chip number and/or the driver/escort was unable to read the chip number, and also when the test for viruses, bacteria or other pathogens ordered by one of the parties gave a positive result (in this case the sender or the contracting party should pay the agreed amount for the service in the amount of 100% of the service price).
§4 Obligations of the Principal
1. The principal is obliged to prepare all veterinary documentation in accordance with § 2 by the day of departure of the animal, and if he is unable to do so, he may appoint a notarized representative or the contractor may help in completing the formalities for a fee.
2. The animal for transport should be clean and properly prepared, and the contractor should be informed truthfully about the habits, mental state and predispositions of the animal and whether it shows aggressive behavior towards strangers.
3. The Principal undertakes to be present at the place of destination at the times indicated by the Contractor or to appoint another person, about whom he shall immediately notify the Contractor by phone or electronically in accordance with § 3 point 3. The Principal shall be immediately informed about changes to the date by telephone or electronically.
§5 Payments
1. When determining the remuneration due to the Contractor, the rates according to the price list generally used by him or specified in a specific offer are adopted. 2. Fees for the service performed will be made by the Principal by the time of departure of the animal at the latest, in cash or by bank transfer (the date of payment is the date of crediting the Contractor's account) to the bank account indicated in the contract for the provision of services. If the parties agree otherwise, payment may be made upon receipt of the animal from transport in cash. The Contractor may make the commencement of the order conditional upon the payment of an advance payment. 3. The Contractor's remuneration may be increased if:
in a manner independent of the Contractor and impossible to predict, there have been significant changes in taxation or other public charges, or in transport, freight and similar costs, or the recipient is not a VAT payer or otherwise does not settle with the Tax Office at the destination ( residence, breeding, etc.)
during the performance of the contract, at the request of the Sender/Recipient, additional activities were performed or the order was extended to include new items, or the performance of additional activities turned out to be necessary in order to perform the order;
the cost of completing the necessary veterinary documentation is PLN 50 once plus all costs incurred by the Contractor in connection with the performance of this activity.
Prior to determining the remuneration, the Principal did not provide all the relevant circumstances surrounding the performed order;
the order completion time was significantly extended for reasons not attributable to the Contractor - force majeure
the recipient or the sender will request an additional veterinary service in the form of a quick test for viral, bacterial diseases or other pathogens, e.g. Lambia. The cost of such a test is EUR 50 or PLN 210.
4. The Principal is always obliged to reimburse the costs incurred by the Contractor imposed by any authorities. The above-mentioned costs are also reimbursable if the Contractor uses subcontractors.
5. The Principal is always obliged to reimburse the costs incurred by the Contractor in the event of the situation described in §3 point 7 in the amount of PLN 2.50 for each kilometer between the Contractor's seat and the Principal's seat - the place of sending / receiving the animal, or 100% of the transport costs when a rapid test for viruses, bacteria or other pathogens gives a positive result.
6. The contractor makes the release of the animal from transport dependent on the settlement of payments according to
§5 point 2. 7. In the case of the situation described in §5 point 6, the Contractor has the right to place the animal in a hotel for animals until the payment is settled. The cost of staying in a hotel is added to the remuneration for the Contractor.
§6 Cancellation of the reservation
1. The Principal may terminate the contract (cancel the reservation):
Free of charge up to 14 days before the planned departure.
Within 14 - 7 days before the planned departure, the Principal undertakes to pay 40% of the contract value by the date indicated in the contract.
Within 6 - 0 days before the planned departure, the Principal undertakes to pay 100% of the contract value by the date indicated in the contract.
2. The Principal may transfer the reservation once, at any time, to a date indicated by him, not later than 1 year. The fee for rescheduling is PLN 150.
3. When changing the date of transport, the Principal has the right to change the transported animal and the place of sending or receiving the animal. The Contractor will calculate the change according to the applicable price list (not less than the value of the original contract), about which he will immediately inform the Principal for approval.
4. The fees for the reservation that is changed will be paid by the Customer by the day of the original departure. Other fees no later than the day of actual
departure.
5). In the event that the number of animals registered for carriage on a given route is lower than 5 (five), the Contractor reserves the right to cancel the scheduled course for organizational reasons. In this case, the Client has the right to choose one of the following options:
(a) the return of the advance payment within 30 days of the date of cancellation of the course, or
b) free change of reservation to another available date of service, without charging a fee for changing the date.
If you want the record to better secure your business, you can clarify it:
The contractor shall inform the Principal of the cancellation of the course immediately after it has been established that a minimum number of 5 animals on the route has not been reached. Cancellation of the course for this reason does not constitute a non-performance of the contract due to the fault of the Contractor and does not give rise to the Customer the right to seek compensation or other claims other than the return of the advance payment or the free change of the booking date.
§7 Final Provisions
1. These Animal Transport Regulations constitute the general rules that apply between the Principal and the Contractor, unless the parties agreed otherwise in a specific individual contract. 2. In matters not covered by the individual contract or the Animal Transport Regulations, the relevant provisions of the Civil Code, public and private international law and accepted customs shall apply. 3. Any deviations from the rules set out in an individual contract or the Animal Transport Regulations require a written form under pain of nullity. In matters of court dispute, the court competent for the registered office of Omnibus.Pets animal transport, Bartosz Gałka, is competent to settle matters related to the transport service.
